Our two teenage clients lost their father when he was fatally injured working for a construction developer. The defendant’s insurance company wrongfully denied the claim and refused to provide coverage for the loss or to defend it’s insured. We entered into a consent judgment with the developer and took an assignment of it’s breach of contract and it’s bad faith claim against it’s insurance company. After 5 years of litigation and an appeal the insurance company paid 10 times the original coverage limits to settle the case. The recovery enabled the children to pay for college, purchase a home for themselves and their mother, who worked 2 and sometimes 3 jobs to support them after the death of their father.
